- This Policy on Personal Data Processing is established in accordance with the requirements of the Law from № 45 от 2021 "On Personal Data." It defines the procedures for processing personal data and the security measures taken by L.L.C "BLACK COSMETIC PERFUMES & COSMETICKS TRADING CO." (hereafter referred to as the "Operator").
1.1. The Operator's primary goal and condition of its activities is to uphold the rights and freedoms of individuals concerning the processing of their personal data, including the protection of privacy, personal, and family secrets.
1.2. This policy applies to all information that the Operator can obtain about visitors to the website

- 2.1. Automated processing of personal data—processing of personal data using computer technology.

- 2.11. Provision of personal data—actions aimed at disclosing personal data to a specific person or group of persons.
- 2.12. Distribution of personal data—any actions aimed at disclosing personal data to an unspecified circle of people (transmission of personal data) or acquainting an unlimited number of people with personal data, including the publication of personal data in the media, placement in information and telecommunication networks, or providing access to personal data in any other way.
- 2.13. Cross-border transfer of personal data—the transfer of personal data to the territory of a foreign state to a foreign state authority, foreign physical or foreign legal entity.
- 2.14. Destruction of personal data—any actions resulting in the irreversible destruction of personal data making further recovery of the content of personal data in the personal data information system impossible and/or resulting in the destruction of physical carriers of personal data.
- Principal Rights and Obligations of the Operator
- 3.1. The Operator has the right to:
- receive accurate information and/or documents containing personal data from the data subject;
- continue processing personal data without the subject's consent if the subject withdraws consent for processing, or requests cessation of processing, provided there are grounds specified in the Law on Personal Data;
- independently determine the composition and list of measures necessary and sufficient to ensure the obligations provided by the Law on Personal Data and the regulations adopted in accordance with it are met, unless otherwise provided by the Law on Personal Data or other laws.
3.2. The Operator is obligated to:
- provide the personal data subject with information regarding the processing of their personal data upon request;
- organize the processing of personal data in accordance with the current legislation of the United Arab Emirates;
- respond to inquiries and requests from personal data subjects and their legal representatives in accordance with the requirements of the Law on Personal Data;
- inform the authorized body for the protection of the rights of personal data subjects about the necessary information within 10 days from the date of receipt of such a request;
- publish or otherwise ensure unrestricted access to this Policy on the processing of personal data;
- take legal, organizational, and technical measures to protect personal data from unauthorized or accidental access, destruction, alteration, blocking, copying, provision, dissemination of personal data, and from other unlawful actions in relation to personal data;
- cease transmission (distribution, provision, access) of personal data, stop processing and destroy personal data in the manner and cases provided by the Law on Personal Data;
- fulfill other duties provided by the Law on Personal Data.
- Principal Rights and Obligations of Personal Data Subjects
- 4.1. Personal data subjects have the right to:
- obtain information regarding the processing of their personal data, except as provided by laws. Information is provided by the Operator in an accessible form and must not contain personal data related to other personal data subjects, unless there are legal grounds for disclosing such personal data. The list of information and the procedure for its receipt are established by the Law on Personal Data;
- demand from the operator the clarification of their personal data, their blocking, or destruction if the personal data are incomplete, outdated, inaccurate, unlawfully obtained, or are not necessary for the stated purpose of processing, as well as to take measures provided by law to protect their rights;
- set a condition of prior consent for the processing of personal data for the purposes of marketing goods, works, and services;
- withdraw consent for the processing of personal data, as well as to send a demand for the cessation of processing personal data;
- challenge in the authorized body for the protection of the rights of personal data subjects or in court the unlawful actions or inaction of the Operator when processing his personal data;
- exercise other rights provided by the legislation of the UAE.
4.2. Personal data subjects are obligated to:
- provide the Operator with accurate data about themselves;
- inform the Operator about the clarification (update, change) of their personal data.
4.3. Persons who provided the Operator with inaccurate information about themselves, or information about another personal data subject without their consent, are liable in accordance with the legislation of the UAE.
- Principles of Personal Data Processing
- 5.1. The processing of personal data is carried out on a lawful and fair basis.
- 5.2. The processing of personal data is limited to achieving specific, predefined, and lawful purposes. The processing of personal data incompatible with the purposes of collecting personal data is not allowed.
- 5.3. It is not allowed to merge databases containing personal data being processed for purposes that are incompatible with each other.
- 5.4. Only personal data that meet the purposes of their processing are subject to processing.
- 5.5. The content and volume of processed personal data correspond to the declared purposes of processing. The excessiveness of processed personal data in relation to the declared purposes of their processing is not allowed.
- 5.6. When processing personal data, the accuracy of personal data, their sufficiency, and, if necessary, relevance to the purposes of processing personal data are ensured. The Operator takes necessary measures and/or ensures their implementation to delete or clarify incomplete or inaccurate data.
- 5.7. Storage of personal data is carried out in a form that allows determining the subject of personal data, no longer than required by the purposes of processing personal data, unless the storage period of personal data is established by law, contract, whose party, beneficiary, or guarantor is the subject of personal data. Processed personal data are destroyed or anonymized upon achieving the purposes of processing or if further achievement of these purposes is not necessary unless otherwise provided by law.

- Legal basis: constitutional documents of the Operator.
- Types of personal data processing: collection, recording, organization, accumulation, storage, destruction, and anonymization of personal data.
- Conditions for Processing Personal Data
- 7.1. The processing of personal data is carried out with the consent of the personal data subject for processing his personal data.
- 7.2. The processing of personal data is necessary to achieve the goals set by an international treaty of the United Arab Emirates or by law, to perform the functions, powers, and duties imposed on the operator by the legislation of the United Arab Emirates.
- 7.3. The processing of personal data is necessary for the administration of justice, the execution of a judicial act, an act of another body or official that must be executed in accordance with the legislation of the United Arab Emirates on enforcement proceedings.
- 7.4. The processing of personal data is necessary for the performance of a contract, whose party or beneficiary or guarantor is the subject of personal data, as well as for concluding a contract at the initiative of the personal data subject or a contract under which the personal data subject will be a beneficiary or guarantor.
- 7.5. The processing of personal data is necessary for the realization of the rights and legitimate interests of the operator or third parties or for achieving socially significant goals, provided that this does not violate the rights and freedoms of the subject of personal data.
- 7.6. The processing of personal data is carried out, access to which is provided to an unlimited number of people by the subject of personal data or at his request (hereinafter—publicly accessible personal data).
- 7.7. The processing of personal data that is to be published or disclosed in accordance with law is carried out.
- Procedure for the Collection, Storage, Transfer, and Other Processing of Personal Data
- The security of personal data processed by the Operator is ensured by implementing legal, organizational, and technical measures necessary to fully comply with the requirements of the current legislation on the protection of personal data.
- 8.1. The Operator ensures the safety of personal data and takes all possible measures to exclude access to personal data by unauthorized persons.
- 8.2. User's personal data will never, under any conditions, be transferred to third parties, except in cases related to the execution of current legislation or if the subject of personal data has given consent to the Operator for the transfer of data to a third party for the fulfillment of obligations under a civil law contract.
- 8.3. In case of detection of inaccuracies in personal data, the User may update them independently by sending a notification to the Operator's email address buh.blackprofessional@mail.ru with the note "Updating personal data".
- 8.4. The term for processing personal data is determined by achieving the purposes for which the personal data were collected, unless another term is provided by the contract or current legislation.
- The User may at any time withdraw his consent to the processing of personal data by sending a notification to the Operator via email to the Operator's email address buh.blackprofessional@mail.ru with the note "Withdrawal of consent to the processing of personal data".
- 8.5. All information collected by third-party services, including payment systems, communication means, and other service providers, is stored and processed by these persons (Operators) in accordance with their User Agreement and Privacy Policy. The Operator stores personal data in a form that allows determining the subject of personal data, no longer than required by the purposes of processing personal data, unless the storage period of personal data is established by law, contract, whose party, beneficiary, or guarantor is the subject of personal data.
- 8.9. The condition for the cessation of processing personal data may be the achievement of the purposes of processing personal data, the expiration of the consent term of the personal data subject, the withdrawal of consent by the personal data subject, or the demand for the cessation of processing personal data, as well as the detection of unlawful processing of personal data.
- List of Actions Performed by the Operator with the Obtained Personal Data
- 9.1. The Operator carries out the collection, recording, organization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, and destruction of personal data.
- 9.2. The Operator carries out automated processing of personal data with the receipt and/or transmission of the obtained information via information and telecommunication networks or without them.
- Cross-Border Transfer of Personal Data
- 10.1. Before starting the activity related to the cross-border transfer of personal data, the Operator is required to notify the authorized body for the protection of the rights of personal data subjects of its intention to carry out the cross-border transfer of personal data (such notification is sent separately from the notification of the intention to process personal data).
- 10.2. Before submitting the above notification, the Operator is required to obtain the relevant information from the authorities of the foreign state, foreign physical persons, and foreign legal entities to whom it is planned to transfer personal data.
- Confidentiality of Personal Data
- The Operator and other persons who have gained access to personal data are obliged not to disclose to third parties and not to distribute personal data without the consent of the subject of personal data, unless otherwise provided by law.

- 12.1. The User may obtain any clarifications on issues concerning the processing of his personal data by contacting the Operator via email buh.blackprofessional@mail.ru.
- 12.2. Any changes to the policy on the processing of personal data by the Operator will be reflected in this document. The policy is effective indefinitely until it is replaced by a new version.
